Non-Refundable Premium: California Insurance Code Section 1816 establishes that bail bond premiums are non-refundable once the bail bond is executed, regardless of the outcome of the case, including dismissals, acquittals, or early resolution.
Co-Signer Obligations: By co-signing (acting as indemnitor) on a bail bond, you accept financial and legal responsibility for ensuring the defendant appears at all required court dates. If the defendant fails to appear, you may be liable for the full bail amount.
Collateral: Depending on the bail amount and circumstances, collateral may be required to secure the bail bond. Terms of collateral will be disclosed in the written bail agreement prior to execution.
Premium Rate: California law sets the bail bond premium at 10% of the total bail amount. This rate is fixed by the California Department of Insurance and cannot be negotiated below this amount.
