This process typically takes 2โ€“8 hours. Once booking is complete, a bail amount is assigned based on the charges and the county's bail schedule.

Step 02

Bail is Set

A bail amount is determined either by the county bail schedule (a standard chart based on the charges) or by a judge at a arraignment hearing. Bail can range from a few hundred dollars to hundreds of thousands depending on the severity of the charges.

Bail exists to ensure the defendant returns to court. It is not a fine or a punishment โ€” it is a financial guarantee of appearance.

Step 04

Sign the Bail Agreement

Once approved, you (as the co-signer or indemnitor) will sign a bail bond agreement. This document establishes your responsibility to ensure the defendant appears at all court dates.

Clearpath provides digital signing โ€” you can complete this securely online without visiting our office. The premium (10% of the total bail amount as set by California law) is collected at this time.

Important: The bail bond premium is non-refundable under California law once the bond is executed โ€” regardless of the outcome of the case.

Step 05

Bond is Posted

Clearpath posts the bail bond directly with the jail facility on the defendant's behalf. We handle all paperwork and coordinate with jail staff to process the release as quickly as possible.

Most facilities process releases within 2โ€“8 hours of the bond being posted. Some facilities are faster. We will keep you updated throughout the process.

Step 06

Your Loved One Comes Home

Once processed, the defendant is released. They are required to appear at all future court dates as a condition of the bail bond. Missing a court date can result in re-arrest and forfeiture of the bond.

Forfeiture
